Insofar as the use is based on declarations of consent, the use takes place until receipt of the revocation. We would like to point out that due to legal obligations, in particular tax and commercial regulations, we may be obliged to archive the relevant personal data even beyond the time of the effectiveness of the revocation. They will be deleted after expiry of the respective statutory periods.

2. Usage data

In addition to the information you provide independently, we automatically collect a number of data within the scope of the use of our websites and other Gamebook Studio HQ services, in particular on the type and scope of the use of our services without any action on the part of the user.

a) What data is collected automatically?

The automatically collected data does not include directly personal data such as the IP assigned to you at the time of access (in anonymised form), the duration of access, the pages displayed as well as other data automatically transmitted by your PC, e.g. in the form of log files with information in particular on the hardware you use, your operating system, browser information, language settings, your screen resolution and your access provider.

In the context of the use of our Gamebook Studio HQ services, we also collect a series of service-related data, e.g. about the functions of a service used by you, game statistics, achieved scores and achievements, user rankings and the time you spend on our games as well as the pages and links which you call up in the context of our services. This information is stored on your Gamebook Studio HQ account and is used for statistical analysis of your usage (see below).

b) For what purposes do we collect, process and use usage data?

We use your data to enable you to use our services, to correct technical problems, to ensure the continued functioning of our products and services and to improve and develop them according to user needs. We use the automatically collected usage data, which is not stored for your Gamebook Studio HQ account, in particular for the following purposes:

  • to determine the success of marketing activities, in particular conversion rates for advertisements and newsletters;

  • to allow you to link our services to your public profiles on social networks or other third party services;

  • to fulfil your orders and send you an order confirmation;

  • to authenticate your software and verify usage rights;

  • to determine your approximate location in order to provide country and language specific services and features and statistical analysis of the use of our services.

  • to tailor the advertising within our Services to your specific interests by matching you to specific interest groups based on this information.

Your gaming statistics are also used to evaluate your gaming performance and to create a ranking in relation to other users. If you participate in competitions or other online gaming events, the statistical data generated by your participation (such as your results, placings and successes) can be viewed by other users of our services by naming your user name. We use this information to create and publish rankings and comparison lists to emphasise the competitive nature, which is an essential factor of our services.

c) How is data collected automatically?

For the automated collection of usage data, we use technologies such as cookies to passively collect usage data on our websites without your active involvement. This includes in particular:

(a) Cookies

Cookies are small text files that are stored on your computer or other device when you use our Services. Such cookies may store usage data to store your preferences, login details and settings for future visits, to detect illegal use of our Services or to personalise advertisements for that user within our Services or on third party websites. Cookies may link to information about purchases you have made, pages you have viewed or games you have played. This information is used, for example, to track your shopping cart and ensure that you are not repeatedly shown the same advertisements. In addition, we use cookies to provide you with content and advertising tailored to your interests and to track your use of the website or other Gamebook Studio HQ services for statistical purposes.

In addition to the cookies that we set when you use our services, third-party providers may also place cookies when you visit our websites. This happens on the one hand because we have commissioned third parties to collect information for us, e.g. for statistical usage analysis (e.g. as part of the use of Google Analytics); on the other hand because our pages contain content or advertisements from third parties. Your browser may connect directly to the servers of the third-party providers to access such third-party content, and they may place their own cookies on your terminal device.

Most browsers are automatically set to accept cookies when you visit a website. You can disable cookies or set your browser to warn you when cookies are being sent. However, if cookies are disabled, some areas of our websites will not function properly. You can set your web browser to warn you when cookies are attempted to be placed on your computer or to restrict the type of cookies you allow.

We may also use Flash cookies, also known as "Local Shared Objects", on our pages using Adobe technology. Flash cookies are small files similar to the browser cookies shown above and are used to store website settings for the personalised appearance of the page. Like normal cookies, flash cookies are displayed as small files on your PC. You can adjust your settings under the item "Global storage settings" on the Adobe website. For more information on Flash Player security and privacy, visit the Adobe website at www.Adobe.com and the Macromedia website at http://www.macromedia.com/support/documentation/de/flashplayer/help/settings_manager.html.

Please note that if you disable cookies, you may not be able to use some of the features and functions for using our Services that require cookies. The cookies we use have a maximum lifespan of 6 months.

(b) Internet protocol files

We may also store log files that your PC automatically transmits to our web server. These log files typically contain information about your computer or terminal device, in particular browser type/version, operating system used, URL of the referring websites and date and time of access.

(c) Analytical Metrics Tool and Other Technologies

Gamebook Studio HQ uses its own analytic metrics tool and third party analytics technologies (about which in a moment) to collect data when you play our games. These tools and technologies collect information about your computer, browser, operating system, feature and page usage, any application software you may be using, and information about the nature and extent of your use of our games, including game metrics and statistics and your purchasing behaviour.

Google Analytics

On some of our websites we use Google Analytics, a web analysis tool from Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA ("Google"). Google Analytics uses "cookies", which are stored on your PC and which enable an analysis of your use of the website. The information generated by the cookie about your use of this website is usually transmitted to a Google server in the USA and stored there. However, we use Google Analytics on our websites with an IP anonymisation tool, with which your IP address recorded by Google Analytics is shortened beforehand by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area and is thus transmitted exclusively anonymised. Google uses the information collected to statistically evaluate your use of the website for us, to compile reports on website activity and to provide us with other services associated with the website and internet use. The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data.

You can deactivate the Google Analytics function using a browser add-on, which you can download at https://tools.google.com/dlpage/gaoptout. To do this, you must install this browser add-on. This will prevent analysis information from being sent to Google.

Piwik

We also use the Piwik analysis tool on our websites. Piwik also uses cookies to collect information about your use of our website, including your IP address, which is shortened for anonymisation purposes, and to transfer this information to our own servers. We use this information to statistically analyse your use of the website for us, to compile reports on website activity and to provide us with other services associated with the website and internet use. In this way, we can optimise our service and adapt it to the needs of the users. Since your IP address is anonymised immediately, you as a user cannot be identified by us. The information generated by Piwik about your use of this website is not passed on to third parties.

You can prevent Piwik from collecting information about your use of our services by disabling the use of cookies in your browser settings or by setting your browser to warn you when cookies are being sent. However, with cookies disabled, some areas of our websites will not function properly. You can set your web browser to warn you when cookies are attempted to be placed on your computer or to restrict the type of cookies you allow.

Alternatively, you can prevent the analysis function by means of an opt-out cookie, which you can activate here. Please note that if cookies are deactivated or deleted, this opt-out cookie may also be deleted and must be set again.

Please note that if you have activated an adblocker or similar programme, you may not be able to opt-out.

Please note that if you have activated an adblocker or similar programme, you may not be able to use the opt-out above.

(d) Clear GIFs and tracking pixels

Clear GIFs (also known as web bugs, beacons, tracking pixels or tags) are small graphic images placed in a web page, web-based document or email message. Clear GIFs are invisible to the user because they are usually very small (only 1 x 1 pixel in size) and the same colour as the background of the web page, document or email message. We use Clear GIFs to collect statistical usage data about our web pages, features or other elements on a web page. Clear GIFs also allow us, for example, to track whether users arrive at our websites through an advertisement we have placed and whether they register there or use a particular service. We may also use Clear GIFs in our email advertisements or newsletters to track whether you open them and whether you open links in them. We use this information for statistical purposes to analyse and improve the effectiveness of our advertising campaigns and other customer communications. We may also use this information to tailor the advertising within our services to your specific interests by matching you to specific interest groups based on this information.

d) How long is usage data stored?

We store your data, unless we have been given further consent or we are legally or contractually obliged to store data, only for as long as your account is active or for as long as is necessary to provide you with our services and achieve the relevant purpose.

3. Anti-cheat and fraud prevention technology

When you play online, we monitor gameplay through so-called "anti-cheating software" to determine whether users are using cheating software or otherwise interfering with the gameplay provided by the game in an unauthorised manner ("cheating"). This anti-cheating software is installed on your terminal together with the Game.

The Anti-Cheating Software, while you are connecting to our Game online, scans your Game history, Game files and, when operating, the random access memory (RAM) of your hardware to identify unauthorised third party programs running concurrently with your Game and modifications to Game files that enable or encourage cheating. "Unauthorised third party programs" in this sense include, for example, "addons", "mods", "hacks", "trainers" or other "cheats" that enable you to interfere with or modify the gameplay provided by the Game.

If the anti-cheating software detects the use of an unauthorised third party program or any other unauthorised interference with the gameplay of the game, the game will be automatically terminated and we will be notified that a corresponding violation has occurred for your Gamebook Studio HQ account. This notification will include the date, time and classification of the violation. The anti-cheating software will be deactivated when you disconnect from the game server.

4. Registration via single sign-on

(e.g. via Facebook and other third-party accounts)

We offer users the possibility to register for our Gamebook Studio HQ services via Facebook Connect or comparable services of other third-party providers with whom you have an account (e.g. Google Inc., Twitter Inc.) as part of the registration of a new Gamebook Studio HQ account. To register for the Gamebook Studio HQ account, simply use the access data of your Facebook account or your existing account with another platform provider. To register, you will be redirected to the page of this third-party provider where you can log in with your existing user data.

With the registration, your Facebook profile or the profile of the respective third-party provider and our Gamebook Studio HQ services are linked. In doing so, we automatically receive a number of your public profile data from Facebook Inc. or the respective platform provider, namely user ID, name, email address, profile photo, age details, gender, time zone, friend list.

We will store this information about your Gamebook Studio HQ account until revoked and use it in accordance with the information above about the use of inventory data.

When you register for the Gamebook Studio HQ account using your Facebook account or the account of another platform provider, Facebook or the respective platform provider has the possibility to receive data about your use of the Gamebook Studio HQ services and to use it within the framework of its own platform, e.g. by storing certain events, such as game successes and game statistics in your user profile and, if applicable, making them accessible to individual or all users of the platform in your public profile. Before user data is sent to a platform provider for publication in your profile, you will be asked separately to give your consent. In order to obtain more detailed information on the scope of the use of your profile data by the platform provider, we must refer you to the relevant data protection provisions of the respective platform provider. Please note that in the context of the transfer of data to third-party providers, your data may also be transferred to locations outside the European Union (e.g. to the USA).

5. Disclosure of data to third parties

As a matter of principle, we do not transmit any personal user data to third parties without your prior express consent. Under certain circumstances, you may have the opportunity to share information with others within the scope of the Gamebook Studio HQ services, e.g. when you enter personal information in a publicly viewable player or forum profile.

In order to provide some Gamebook Studio HQ services, we work together with service providers (e.g. payment service providers, hosting providers) who may process personal data in connection with the provision of the respective service according to our instructions on the basis of an order data processing agreement.

Your data will only be passed on in exceptional cases if we are obliged or entitled to do so by law or on the binding instructions of a public authority.

6. Where is the data stored?

We store and process the data collected in connection with the use of Gamebook Studio HQ services exclusively on servers located within the European Union.

7. What protective measures are in place for your personal data?

We make reasonable efforts to protect your personal data and to ensure the security of our systems according to the respective state of the art. For this purpose, we use, among other things, current encryption methods. Nevertheless, no method of transmission via the internet or method of electronic data storage is 100% secure. We can therefore not guarantee against unauthorised access to our servers and systems.

8. Social Plugins

On our website we use a number of plugins for social media platforms of the following companies:

To protect your privacy, we integrate social plugins in such a way that they do not transmit data to the respective platform operator without your intervention. The plugins we integrate either require prior activation by you, which you can recognise by a corresponding activation button next to the plugin symbol, or communication with the platform operator takes place via our own servers, so that no direct data flow with the platform operator takes place through your browser.

Please note that in the event that you actively share content via the integrated social plugins, information will still flow to the respective platform provider, which will be assigned to your possibly existing Gamebook Studio HQ account and stored and used in accordance with the data protection conditions of the respective platform provider. Therefore, before actively using the social plugins, please inform yourself about the type and scope of data use with the respective platform operator.

9. Content posted by the user in public forums, blogs, chats and profiles

You may have the opportunity through the Gamebook Studio HQ Services to post information about yourself in our online chats, blogs, noticeboards or publicly viewable user profiles or similar forums on our websites and/or through our Services. Information you disclose in any of these forums is unencrypted, public information that may be perceived by other users of the relevant Service and, if posted on a website, by any third party. In this context, the protection or confidentiality of the information cannot be expected. You should note that any information you submit in the course of these public activities that identifies you may be read, collected, used and processed by other users of these forums in order to send you messages. We are not responsible for any information you make public in these forums that may be used by other users to identify you. Please also note that in the course of normal internet activities, certain technical information may be sent by your browser to third parties such as advertising networks or analytics companies.

We have no control over the information sent by your browser to such networks or third parties and recommend that you ensure that your browser settings prevent the disclosure of information that you do not wish to share. If you choose to post a video, image or photo on any of our websites for general access, you should be aware that it may be processed, collected, copied and/or used by other users without your consent.

We assume no responsibility for the videos, images or photos published by you under your own responsibility within the framework of Gamebook Studio HQ services.

10. use of Gamebook Studio HQ services by minors

Many Gamebook Studio HQ services are intended for a wide range of users. We do not knowingly collect personal information from minors. If we collect age information when a user uses our services and the user identifies as under 16 years of age, we will either not collect personal data from such users or ensure that parental consent is obtained for the collection, use, processing and dissemination of the child's personal data.

Please note as a parent or guardian that if you consent for your child to use Gamebook Studio HQ services, this may include access to internal communication services and forums where your child's posts may become available to a wide audience and through which your child may generally communicate with and disclose personal data to users of all ages.

Parents may modify or withdraw the consent given and may access, edit or request the removal/deletion of their child's personal data by sending an email to the above address.

In the event of a change to this Privacy and Cookie Policy to extend the collection, use, processing or dissemination of the child's personal data to which consent has been given, we will notify the relevant parent.

We encourage you to talk to your child about communicating with strangers and disclosing personal information on the Internet. Under no circumstances will we make a child's participation in an activity - such as a tournament - conditional on the disclosure of more personal information than is necessary for participation under reasonable consideration.

11. Rights of the user

Upon request, we will provide you with information about the data we have stored about you at any time. You can correct, update, block or delete the data provided to us at any time or request us to correct, block or delete your data. Please note that once accounts or data have been deleted, they cannot be restored. When deleting your Gamebook Studio HQ account, we delete all personal data that we do not have to keep for legal or contractual reasons. Stored data will only be stored for the necessary purpose and will be deleted after the reason for storage has ceased to exist.

If we are unable to comply with your request to delete data because the data can or must still be retained for a legally permitted purpose, you have the right to request that your data be blocked for other purposes.

If you have given us express consent to use your data, you can revoke your consent at any time with future effect, for example by cancelling your Gamebook Studio HQ account and ceasing to use the Gamebook Studio HQ services.

To assert your rights or if you have any questions about data protection, you can contact Gamebook Studio HQ GmbH, Wilhelm-Kabus-Straße 77, 10829 Berlin, info@gamebook.studio at any time by letter. We will be happy to help you.
